Leonberg, 04.03.2020. Gemballa GmbH, a world-renowned tuning and refinement company for Porsche, McLaren and other vehicles, is laying criminal charges against Marc Philipp Gemballa, son of the murdered business founder Uwe Gemballa, for trademark infringement and fraud.
In 2010, Gemballa GmbH acquired the trademark rights to the name “Gemballa” as well as various assets of the company “Gemballa Automobiltechnik GmbH”, originally founded in 1981, from the heirs of the owner and founder Uwe Gemballa and the insolvency administrator. With this the continuation of the brand, the workplaces as well as the legacy of this traditional business could be continued. Since then, 15 million euros have been invested to continue development and the company has successfully grown worldwide. Gemballa GmbH is the international owner of several word and figurative marks “Gemballa”.
Marc Philipp Gemballa founded a competing company (MP Gemballa GmbH / Marc Philipp Gemballa GmbH) and is currently attracting customers for his own SuperCar. In doing so, he pretends by consciously exploiting our good reputation and illegally uses the brands and products of Gemballa GmbH. In numerous articles on social media, YouTube videos and press articles, he illegally generates himself as the “continuator of his father’s legend”
Gemballa is exclusively managed by Gemballa GmbH. There is no consent and / or license for Mr. Marc Philipp Gemballa to use the name and / or products of Gemballa GmbH for his own advertising and for other purposes.
Several civil and criminal proceedings have been brought against Mr. Marc Philipp Gemballa and his company MP Gemballa GmbH / Marc Philipp Gemballa GmbH.
