The Louisiana Department of Environmental Quality (“LDEQ”) and Textron Inc. (“TI”) have entered into a settlement agreement (“Agreement”) regarding alleged violations of the Louisiana Hazardous Waste Regulations. See settlement tracking number SA-HE-23-0045.
The Agreement provides that TI is a company that owns and/or operates a ship, boat and armored fighting vehicle manufacturing facility (“Facility”) in New Orleans, Louisiana.
TI denies committing any violations or being responsible for any fines, forfeitures and/or penalties.
LDEQ reportedly conducted an inspection of the TI facility on March 28, 2022. The scope of the inspection was described as determining the degree of compliance with the Louisiana Environmental Compliance Act and Hazardous Waste Regulations.
The TI facility has reportedly already notified LDEQ as a producer of large quantities of hazardous waste. However, a review of the facility’s hazardous waste manifests during the inspection reportedly indicated that the facility was operating as a small hazardous waste generation operation.
The following violations were reportedly identified:
- Failure to mark containers containing universal electronic waste with the words “Universal Waste – Electronics”
- Failure to determine the length of time the universal waste was accumulated from the date it became waste
- Failure to mark containers containing used universal batteries with the words “Universal Waste – Batteries”
- Failure to mark or label containers containing hazardous waste at or near the point of generation where the waste initially accumulates with the words “Hazardous Waste”
- Failure to mark or label containers containing hazardous waste at or near the point of generation where the waste initially accumulates with an indication of the hazards of the contents
- Failure to clearly mark or label above-ground containers used to store used oil with the words “Waste Oil”
- Failure to keep a container containing hazardous waste closed at or near the point of generation where the waste initially accumulates, except when adding, removing, or consolidating the waste.
- Failure to determine whether the solid waste generated constitutes a hazard
The agreement provides for a penalty of $5,000.
