The U.S. Chamber of Commerce and industry groups defended a judge’s decision that unfroze a freeze on federal oil and gas leases, telling the Fifth Circuit that the government pause was a final decision that created instability and threatened to harm the environment.
The Biden administration argues that the pause was not a final action by the agency subject to judicial review. But the pause was the result of the Interior Secretary’s decision on how to implement an executive order, the House told the United States Court of Appeals for the Fifth Circuit.
